Under Payment of Gratuity Act, 1972, for avoiding any payment knowingly makes any false statement or representation shall be punishable with:

imprisonment upto 3 months or fine upto Rs. 10,000/- or both

imprisonment upto 6 months or fine upto Rs. 10,000/- or both

imprisonment upto 3 months or fine upto Rs. 20,000/- or both

imprisonment upto 6 months or fine upto Rs. 20,000/- or both

Explanation:

Payment of Gratuity Act, 1972 Section: 9 Penalties.

(1) Whoever, for the purpose of avoiding any payment to be made by himself under this Act or of enabling any other person to avoid such payment, knowingly makes or causes to be made any false statement or false representation shall be punishable with imprisonment for a term which may extend to six months, or with fine which may extend to 1[ten thousand rupees], or with both.
