Defection is defined as “to abandon a position or association, often to join an opposing group” which essentially describes a situation when a member of a particular party abandons his loyalty towards that party and provide his support (in the form of his vote or otherwise) to another party.
52nd Amendment,1985 inserted the 10th schedule in our Constitution. The 10th Schedule is popularly referred to as : ANTI DEFECTION LAW.
Its basically a process by which legislators may be disqualified on the grounds of defection to another political party.
A member of parliament or state legislature is deemed to have defected on two grounds:
When he voluntarily gives up his membership of a party. If he votes or abstains from voting in such House contrary to any direction issued by his political party or anyone authorised to do so, without obtaining prior permission. However, if the member has taken prior permission, or is condoned by the party within 15 days from such voting or abstention, the member shall not be disqualified.
The power of the speaker increased enormously as Speaker is now final decision maker on anti defection law.
