The Indian Justice Delivery System has always been the toast of everyone's tea. We all know that a fair impartial and efficient system of delivering Justice is the backbone of any democratic country. India's constitution has been adopted and influenced by several other constitutions of the world just to ensure that we have one of the finest and best Justice Delivering System in the world and also to prevent the blunders that were earlier committed. As the nation is developing the needs and wants of the citizens are also changing with the time span. Similarly the need for amendment in age old laws and introduction of new laws have risen from different corners of the country.While studying about the legal system of the country , we have often come across the principle of the 'Rule of Law' which states that the law of the land is supreme .
However this belief was contradicted when the Justice Delivering System started facing certain anomalies or challenges. It's quite apparent that the Indian Judicial System has high pendency of cases in all the courts. Talking about the average 27 million cases are pending in Trial Courts , 70,000 cases are pending in Supreme Court and about 4.5 million cases are pending in the High Court . well lack of infrastructure and lack of ample number of judges in the judicial system are to blamed for the above mentioned data. If we quickly take a tour of the total number of judges and trace out the average , one must be astound to see 13 judges per million , and that too in a country with the population of 122 crore.This gives birth to a very poignant situation where the judges emphasize on acquittal and disposal of the cases instead of delivering justice to the victims. The ratio between the civil and criminal cases is as wide as 2:8 respectively. This depicts a very unhealthy scenario resulting in a rapid increase of crimes and anti social elements.
