Consider the following constitutional features:
1. Doctrine of Sovereignty of Parliament
2. Presence of a nominal Executive
3. Dissolution of the lower house of the Parliament
How many of the above are the essential features of the Parliamentary government as provided under the Constitution of India?
Only one
Only two
All three
None
The Constitution of India has opted for the British Parliamentary System of Government rather than the American Presidential System of Government. • The features of parliamentary government in India are: o Presence of nominal and real executives; Majority party rule, Collective responsibility of the executive to the legislature, Membership of the ministers in the legislature, Leadership of the Prime Minister or the Chief Minister, Dissolution of the lower House (Lok Sabha or Assembly). Hence options 2 and 3 are correct. • There are some fundamental differences between the two. For example, the Indian Parliament is not a sovereign body like the British Parliament. Further, the Indian State has an elected head (republic) while the British State has a hereditary head (monarchy). Hence option 1 is not correct. • Further, unlike the principle of judicial supremacy with that of the American Supreme Court, the scope of judicial review of the power of the Supreme Court in India is narrower than that of what exists in the US.
