Consider the following statements with respect to the Preamble of the Constitution of India:
1. It was not a part of the constitution adopted on 26th November 1949.
2. It specifies justice, liberty, equality, and fraternity as the objectives.
3. It was the first time recognized as part of the constitution in the Berubari Union case in 1960.
How many of the statements given above are correct?
Only One
Only Two
All Three
None
It was not a part of the constitution adopted on 26th November 1949:
The Preamble was indeed a part of the Constitution adopted on 26th November 1949. Thus, the first statement is incorrect.
It specifies justice, liberty, equality, and fraternity as the objectives:
Yes, the Preamble enshrines these values as the fundamental objectives of the Constitution. The Preamble reads:
"WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens: JUSTICE, social, economic and political; LIBERTY of thought, expression, belief, faith and worship; EQUALITY of status and of opportunity; and to promote among them all FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;"
Hence, the second statement is correct.
It was the first time recognized as part of the constitution in the Berubari Union case in 1960:
This is a misconception. In the Berubari Union case of 1960, the Supreme Court observed that the Preamble is not an integral part of the Constitution. However, this viewpoint was overturned in the landmark Kesavananda Bharati case (1973), wherein the court held that the Preamble is an integral part of the Constitution. So, the third statement is incorrect.
